Legal Videography
|
|
Depositions are one of the most common uses of videography in the legal
profession. Creating a certified video record further enhances the official
written transcript by capturing and, more importantly, preserving the
visual and audio record of the proceeding. Video allows a judge and/or
jury to see and hear the actual witness, instead of just listening to
testimony read from a transcript. In many cases seeing hand gestures,
facial expressions and voice inflections when answering specific questions
can play a key role in establishing or disproving credibility. Deponents
tend to be much more relaxed in a conference room rather than a court
room and can handle questions more effectively.
Videotaping depositions or legal proceedings can help preserve testimony
while the issues and/or events are still clear in the mind of the witness.
This can be especially important during long and complex legal matters
or when there is a chance of losing valuable testimony. It can also be
much more cost effective than a live appearance by an expensive expert
witness.
Judges and juries are inclined to pay close attention to the tenor of
a witness’ testimony when recorded on video and presented as evidence
in a court of law.
Each of our Certified Legal Video Specialists has received proper training
on conducting a videotaped deposition which meets the legal standards
of the Federal Rule of Civil Procedure 30(b)(4) and has received certification
from the National Court Reporters Association (NCRA). We are committed
to ensuring our clients achieve success while remaining a disinterested
party and compliant with the Rules of Civil Procedure in all of the reporting
jurisdictions we service.

| Videoconferencing / Testimony of Remote Witnesses - |
|
 |

Click below for a larger image

|
|
Videoconferencing is a cost effective way of holding a meeting or discussion between two or more groups of people who are located in different places. A videoconference can save a busy attorney and their client countless billable hours and expensive travel costs by eliminating the need to have all of the parties in the same location, while still attaining the impact of visual contact which allows you to be face to face with people at other locations. Videoconferencing allows an expert thousands of miles away the ability to consult in minutes, based on real-time information and live feedback. The result: greater efficiency and faster response.
A videoconference to obtain the testimony of remote witnesses under oath is a practical and cost effective way to secure valuable testimony when a witness has a difficult schedule, lives in another state or country, or is simply unable or unwilling to travel to you. Judges and juries are inclined to pay close attention to the tenor of a witness’ testimony when recorded on video and presented as evidence in a court of law.
Our state-of-the-art videoconferencing facility is capable of hosting up to a 384K videoconference call. Our spacious conference room seats up to 12 people comfortably around an executive style conference table with plenty of extra space for additional attendees to be seated around the room. An integrated overhead projector and screen is available for multi media presentations and additional multi-line phones are available for sidebar calls, including a Polycom unit for non videoconference participants. We provide complimentary coffee and water, full catering is available upon request. Use our well-equipped Executive Conference Room for your important meetings without traveling out of Phoenix.
Benefits of Videoconferencing:
- Business Enabler
– Enables the possibility of holding meetings that could not have otherwise
taken place due to logistical, time or financial constraints.
- Meet at a Moments’
Notice – Meetings can be pulled together on a more regular
basis or on a moments’ notice enabling accelerated decision making.
- Real-time Collaboration
– Easily and effectively collaborate globally with out of town clients,
counsel or expert witnesses.
- Reduced T&E Costs
– Significantly reduces travel and expense by allowing a remote participant
worldwide to attend a meeting or deposition.

A video will is not a legal substitute for a written will, but can be used to enhance the meaning of the written will and, in most cases, can provide additional clarity to the beneficiaries of the written will. By videotaping your client reading their will, it affords them the opportunity to demonstrate their physical and mental condition at the time the will was prepared and signed, and clearly eliminates any question of authorship. It allows your client to provide clarity for the beneficiaries of the written will and further explain why specific decisions were made. This in turn affords the beneficiaries an opportunity to see your client signing the written will and observe they were not under any undue duress, outside influence or coercion during the execution of the written will.
If the written will is ever amended, the new information can be added to the end of the existing video. All video wills and amendments will have the date and time stamp on the screen at all times. Carefully recording the entire will reading and execution both visually and audibly could prove invaluable in the event the will is ever contested in a court of law.
Our Certified Legal Video Specialists will assist you in the comfort of your client’s home or in counsel’s offices.

For large and often complex cases, holding mock trials with surrogate juries is an effective way to assess the potential outcome of your case. Attorneys can study and review the results of their mock trial, as well as the deliberation processes of the surrogate jury, before the case actually comes to trial. We can professionally edit the video footage and condense it to be used prior to the trial and also throughout the trial as a convenient and vital reference tool.

| Activities of Daily Living / Day-in-the-Life Documentaries - |
|
 |
|
|
A Day-in-the-Life video, also know as an Activities of Daily Living documentary, is most typically used in personal injury cases. It is a truthful documentation of the actual daily activities of a person and how an incident in this person's life has impacted their ability to function on a day-to-day basis. An Activities of Daily Living documentary is a valuable tool that can accurately demonstrate and provide a clear picture to judges and juries of the daily struggles a client must face as a result of an alleged injury or incident. The video is an excellent way to demonstrate a person’s need for continued care and specialized equipment and can also be used to reinforce the testimony of expert witnesses. The impact upon family and friends can also be shown on the video.
A legal videographer may record all the activities of a client's day including therapy, treatment and physical challenges. The raw video is then edited down to a timely presentation that can be used to possibly obtain a higher settlement offer from the opposing party.

| Settlement Documentaries - |

|
|
A settlement documentary is a video summary of one side of a case. It can be an excellent tool for negotiating an out-of-court settlement and avoiding the expense of a long, drawn out trial. There are no restrictions on the content of a settlement video. It is intended to be a powerful and emotional presentation that will establish blame and illustrate the current and future pain and suffering of your client. This video may contain special lighting, virtual sets, narration, specific charges, graphic images, emotional relatives, and the like for the sole purpose of convincing the opposing party to settle the case as quickly and for the highest monetary value possible.
This video is not intended to be used as evidence in court. However, if a settlement is not reached, it can be re-edited into an Activities of Daily Living documentary that can be presented in court.

| Pre-Construction Surveys - |
|
 |
|
|
A Pre-Construction Survey is intended to protect firms and agencies involved in any form of construction by documenting any pre-existing damage in the area in which construction is to take place. This documentation may include damage to buildings, utilities, streets, street signs and lights, sidewalks, curbs and gutters, landscaping, fences and much more. Once armed with this information, a construction firm or other agency can easily defend itself against claims for damages in lawsuits. A video survey is a very inexpensive way to insure that you have clear and undeniable evidence of any and all pre-existing conditions.
It is important to have this video survey filmed by a competent videographer to avoid mistakes that could lead to the video being impeached and becoming inadmissible in court.

A site inspection video is most often used in cases that deal with construction and engineering, safety, property damage, and accident re-creation. This type of video is a very effective tool for presenting information about a particular site either in the courtroom or in settlement negotiations. At the direction of the site inspector and/or attorney, the site would be videotaped from a variety of angles with a specific area of interest. A technician or inspector may be shown on camera taking measurements or doing testing in the area, and brief statements related to their findings or conclusions, as well as identifying information, may also be recorded. Still pictures can also be taken and edited into the video. If necessary, a number of regularly scheduled site inspections may be required to document changes in conditions over a certain period of time.
All site inspections will contain date and time of day information on the bottom section of the screen, the opening title identifying the location and production date, and information identifying all interviewed individuals. Upon request, the case information along with the name of attorney can also be included.
